Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off Period:
    The period within which the consumer may exercise their right of withdrawal.
  • Consumer:
    A natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
  • Day:
    Calendar day.
  • Continuous Transaction:
    A distance contract regarding a series of products and/or services whose supply and/or purchase obligation is spread over time.
  • Durable Medium:
    Any tool that enables the consumer or entrepreneur to store information addressed to them personally in a way that allows future consultation and unaltered reproduction.
  • Right of Withdrawal:
    The option for the consumer to cancel the distance contract within the cooling-off period.
  • Entrepreneur:
    The natural or legal person who offers products and/or services to consumers at a distance.
  • Distance Contract:
    An agreement in which, within the framework of a system organized by the entrepreneur for distance selling of products and/or services, one or more techniques for distance communication are used exclusively until the conclusion of the contract.
  • Means of Distance Communication:
    A tool that can be used for concluding an agreement without the consumer and entrepreneur meeting simultaneously in the same space.

Article 3 – Applicability

  • These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.
  • Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer.
  • A purchase agreement can only be concluded if the consumer accepts these terms and conditions.
  • If the distance contract is concluded electronically, the text of these general terms may be provided to the consumer electronically in a way that allows for easy storage on a durable medium.

Tell Tale Adventures reserves the right to modify these general terms at any time.

Article 4 – The Offer

  • If an offer has a limited validity period or is made under certain conditions, this will be explicitly stated in the offer.
  • The offer includes a complete and accurate description of the products offered, sufficiently detailed for the consumer to evaluate the offer properly. Any images used are as accurate as possible. However, the consumer cannot derive rights from these representations.
  • Each offer contains clear information on the following:
    • Price, including taxes.
    • Any delivery costs.
    • The method of payment, delivery, or performance.
    • Applicability of the right of withdrawal.
    • The duration for acceptance of the offer.
    • Whether the contract will be archived, and how the consumer can access it.
    • Steps to correct input errors before placing the order.
    • Any applicable languages besides Dutch.
    • Applicable codes of conduct.
    • Minimum contract duration if applicable.

All offers by Tell Tale Adventures are non-binding invitations to order products.

Article 5 – The Agreement

  • The agreement is concluded at the moment the consumer accepts the offer and meets the associated conditions.
  • If the consumer accepts the offer electronically, the entrepreneur will confirm receipt of acceptance electronically. Until this confirmation is received, the consumer may terminate the agreement.
  • If the agreement is concluded electronically, the entrepreneur will ensure appropriate technical and organizational measures for data transfer security.
  • The entrepreneur may investigate the consumer’s ability to meet payment obligations.

Article 6 – Right of Withdrawal

  • The consumer has the right to return products within 14 days of receipt. After notifying the entrepreneur of the return, the consumer has an additional 14 days to return the product.
  • Conditions for returns:
    • The product must be returned with all accessories in its original state and packaging.
    • The consumer must notify the return via the website’s Contact Form.
    • Return shipping costs are borne by the consumer.

Article 7 – Exclusion of Right of Withdrawal

  • The right of withdrawal may be excluded for products clearly personalized, perishable or of downloadable nature.
  • The exclusion must be communicated clearly before the contract is concluded.

Article 8 – Price

  • All product prices are in euros and include applicable VAT.
  • Delivery charges are listed clearly before finalizing the order.

Article 9 – Conformity and Warranty

  • If a product is defective upon delivery, the consumer must notify Tell Tale Adventures within 24 hours via email.
  • Proof may be asked in the form of pictures and/or description of the defect.
  • Consumers may request a replacement, refund, or alternative product.

Article 10 – Delivery and Execution

  • The delivery time begins after the agreement is finalized.
  • If delivery is delayed, the consumer will be informed within one month.

Article 11 – Payment

  • Payments must be made before delivery unless otherwise agreed (e.g., Paypal, Ideal, Bancontact, Afterpay).
  • The consumer is responsible for providing accurate payment information.

Article 12 – Complaints Procedure

  • Complaints should be submitted promptly, clearly describing the issue.
  • Tell Tale Adventures will respond within 14 days with a resolution or timeframe for further communication.
  • Complaints submitted to the entrepreneur will be answered within 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the entrepreneur will respond within 14 days with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed response.
  • If a dispute between the consumer and Tell Tale Adventures cannot be resolved by the parties involved, they may engage a mediating party at their own expense, provided the nature of the dispute permits such mediation.

It is recommended to first report complaints directly to Tell Tale Adventures by emailing tellme@telltaleadventures.com or using the Contact Form.
If this does not resolve the issue, the dispute can be submitted for mediation through Stichting WebwinkelKeur.

From February 15, 2016, EU consumers can also file complaints via the ODR platform of the European Commission, available at http://ec.europa.eu/odr. If your complaint is not being handled elsewhere, you may submit it through the European Union’s platform.

Article 13 – Intellectual Property

The consumer expressly acknowledges that all intellectual property rights concerning displayed information, communications, or other expressions related to the products and/or the website belong to Tell Tale Adventures or other rightful owners. All illustrations and texts are copyrighted and are not to be used without proper consent from Tell Tale Adventures and/or other rightful owners.

Article 14 – Personal Data

Tell Tale Adventures will process the consumer’s data solely in accordance with its privacy policy. Tell Tale Adventures adheres to applicable privacy laws and regulations.

Article 15 – Applicable Law and Competent Court

All offers from Tell Tale Adventures, its agreements, and their execution are exclusively governed by Dutch law. The applicability of the Vienna Convention on the International Sale of Goods is explicitly excluded.

Article 16 – Links

Tell Tale Adventures‘ website may contain third-party advertisements or links to other sites. Tell Tale Adventures has no control over the privacy policies of these third parties or their websites and is not responsible for them.

Article 17 – Your Rights

You may always inquire about the data Tell Tale Adventures processes about you by sending an email. You may also request corrections, additions, or other changes, which Tell Tale Adventures will process as soon as possible. If you no longer wish to receive information, you can inform Tell Tale Adventures. Information will only be sent if you have provided your email address for that purpose.

Article 18 – Additional or Deviating Provisions

Additional or deviating provisions from these general terms and conditions must not disadvantage the consumer and must be recorded in writing or in a manner that allows the consumer to store them accessibly on a durable data carrier.
